Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Board for Contractors intends to consider amending 18VAC50-22, Board for Contractors Regulations, and 18VAC50-30, Individual License and Certification Regulations. The purpose of the proposed action is to remove the cap on exam fees and allow exam vendor contracts to be negotiated without a cap to expand services, particularly to include multiple language services and remote proctoring. The board currently adheres to the provisions of the Virginia Public Procurement Act (§ 2.2-4300 et seq. of the Code of Virginia). Other Department of Professional and Occupational Regulation boards have amended their regulations to include this provision of offering examinations in languages other than English. Offering Board for Contractors examinations in languages other than English and using remote proctoring support workforce development and promote a positive business environment and license mobility. The board also intends as part of this action to remove an obsolete section that lists the board as the administrator of examinations.

The agency intends to hold a public hearing on the proposed action after publication in the Virginia Register.
