MOTOR VEHICLE DEALER BOARD

Report of Findings

Pursuant to § 2.2-4007.1 of the Code of Virginia, the Motor Vehicle Dealer Board conducted a small business impact review of 24VAC22-11, Public Participation Guidelines, and determined that this regulation should be retained in its current form. The Motor Vehicle Dealer Board is publishing its report of findings dated January 15, 2020, to support this decision in accordance with § 2.2-4007.1 F of the Code of Virginia.

On January 13, 2020, the Motor Vehicle Dealer Board approved the periodic review and continuation of this regulation. The board received no complaints or comments regarding the need to repeal or amend this regulation, and the regulation is written clearly and is easy to understand. This regulation does not overlap, duplicate, or conflict with any federal or state law or regulation, and this regulation was last reviewed on November 26, 2008.

The Motor Vehicle Dealer Board is publishing its report of findings dated January 15, 2020, to support this decision in accordance with § 2.2-4007.1 F of the Code of Virginia.

On January 13, 2020, the Motor Vehicle Dealer Board approved the periodic review and continuation of this regulation. The board received no complaints or comments regarding the need to repeal or amend this regulation, and the regulation is written clearly and is easy to understand. This regulation does not overlap, duplicate, or conflict with any federal or state law or regulation. This regulation was amended and reviewed on September 10, 2014, to amend the 2014 General Assembly "Omnibus" MVDB bill. One of the features of this 2014 bill was to authorize the board to set most fees up to the limits allowed in the Code of Virginia without the need to adopt regulations. The only fees that were not included in the 2014 legislation are the registration fees for dealer license plates, which are spelled out specifically in the Code of Virginia.

The Motor Vehicle Dealer Board is publishing its report of findings dated January 15, 2020, to support this decision in accordance with § 2.2-4007.1 F of the Code of Virginia.

On January 13, 2020, the Motor Vehicle Dealer Board approved the periodic review and continuation of this regulation. Recertification requirements for independent (used) car dealers help used car dealers keep up with Virginia Code and policy changes. This continuing education also refreshes their knowledge of all laws and regulations dealers need to comply with. Educated dealers are less likely to have problems with consumers and regulators, and education enhances the professionalism of the motor vehicle sales industry. The board received no complaints or comments regarding the need to repeal or amend this regulation, and the regulation is written clearly and is easy to understand. This regulation does not overlap, duplicate, or conflict with any federal or state law or regulation, and this regulation was last reviewed on September 2, 2010.
