Notice of Objection to Fast-Track Rulemaking Action

REGISTRAR'S NOTICE: Pursuant to § 2.2-4012.1 of the Code of Virginia, the Board for Barbers and Cosmetology has filed a notice of objection to the fast-track rulemaking action published in 36:9 VA.R. 1077-1079 December 23, 2019. The board intends to proceed with the standard promulgation process set out in Article 2 (§ 2.2-4006 et seq.) of Chapter 40 of Title 2.2 of the Code of Virginia, with the initial publication of the fast-track regulation serving as the Notice of Intended Regulatory Action.

Titles of Regulations: 18VAC41-20. Barbering and Cosmetology Regulations (amending 18VAC41-20-260).

18VAC41-70. Esthetics Regulations (amending 18VAC41-70-260).

Statutory Authority: § 54.1-201 of the Code of Virginia.

The Board for Barbers and Cosmetology has filed a notice of objection to the fast-track rulemaking action for 18VAC41-20, Barbering and Cosmetology Regulations, and 18VAC41-70, Esthetics Regulations. The fast-track action was published in Volume 36, Issue 9, pages 1077 through 1079 of the Virginia Register of Regulations on December 23, 2019.

The board received more than the requisite 10 objections to the amendments. The objections pertained to the proposed amendment eliminating the requirement that apprentices wear badges to identify themselves as such. Due to the objections, the board has discontinued using the fast-track rulemaking process.

The board will proceed with adoption of the amendments using the standard process under Article 2 (§ 2.2-4006 et seq.) of the Administrative Process Act, and the publication on December 23, 2019, will serve as the Notice of Intended Regulatory Action in accordance with § 2.2-4012.1 of the Code of Virginia.
