BOARD OF DENTISTRY

Agency Decision

Title of Regulation: 18VAC60-21. Regulations Governing the Practice of Dentistry.

Statutory Authority: § 54.1-2400 of the Code of Virginia.

Name of Petitioner: Nicholas Ilchyshyn, DDS.

Nature of Petitioner's Request: To allow dentists who serve as preceptors for dental students to receive continuing education credit for such work.

Agency Decision: Request denied.

Statement of Reason for Decision: The petition was considered by the board at its meeting on December 14, 2018. While the board is fully supportive of mentoring and appreciative of licensees who perform those duties, it has declined to amend the regulations to use those hours for continuing education. The hours recognized by the Board of Medicine may be used to satisfy Type 2 hours, but not Type 1 hours. The Board of Medicine requires 60 hours per biennium, at least half of which must be Type 1 hours. The Board of Dentistry requires 15 hours for annual renewal and does not recognize hours that are not approved by an accredited sponsor or organization.

BOARD OF LONG-TERM CARE ADMINISTRATORS

Agency Decision

Title of Regulation: 18VAC95-30. Regulations Governing the Practice of Assisted Living Facility Administrators.

Statutory Authority: §§ 54.1-2400 and 54.1-3102 of the Code of Virginia.

Name of Petitioner: Daniel Cassiere.

Nature of Petitioner's Request: The petitioner requests amendments to (i) allow an administrator with one year of total experience to be a preceptor, (ii) make it mandatory for an employer to inform the board about employee work dates, and (iii) add other types of documents to prove work history.

Agency Decision: Request denied.

Statement of Reason for Decision: At its meeting on December 13, 2018, the board considered the petition and comments received and decided to retain the current requirements. While members appreciated the petitioner's point of view, it was their conclusion that the requirement of one-year of full-time employment as an administrator is the minimal amount of experience necessary to adequately serve as a preceptor for an administrator-in-training. Additionally, the board did not accept the request to require facilities to verify employment or to accept other means of verification. The board does not license or regulate the facilities, only the administrators of those facilities, and acceptance of pay stubs may not adequately provide evidence of full-time employment.
