Formation of a Stakeholder Group for a Regulation Concerning Prohibitions on Use of Certain Hydrofluorocarbons in Specific End-Uses

Item 378 of Chapter 1289 of the 2020 Acts of Assembly requires the State Air Pollution Control Board to adopt regulations to prohibit the sale, lease, rent, installation, or entry into commerce in Virginia of any products or equipment that use or will use hydrofluorocarbons for the applications and end uses restricted by Appendix U and Appendix V of Subpart G of 40 CFR Part 82, as those read on January 3, 2017. The 2020 Special Session I amended Item 378 to require the board to solicit input from a work group composed of extruded polystyrene boardstock and billet manufacturers located in Virginia and other relevant stakeholders to determine a feasible date by which those manufacturers should be required to comply with that proposed regulation. The board is seeking nominations for the stakeholder work group required by Item 378. Persons nominated should represent an extruded polystyrene boardstock and billet manufacturer located in Virginia, a trade group that represents extruded polystyrene boardstock and billet manufacturers located in Virginia, or other relevant stakeholders. Nominations should include the name of the nominee, the manufacturer or trade group represented, and contact information for the nominee including phone number, mailing address, and email address. Nominations must be sent by U.S. Postal Service mail or by email to the contact person listed. Nominations must be received no later than December 21, 2020. Meetings of the stakeholder work group will be held in January 2021 and may be electronic-only meetings consistent with the effective Executive Orders and statutory requirements under the Governor's declared State of Emergency. Nominees approved as members of the work group by the Director, Department of Environmental Quality will be notified by email. Meetings will be open to the public and will be announced on the Virginia Regulatory Town Hall at https://www.townhall.virginia.gov/L/meetings.cfm?time=future at least three days before the meeting date.

Development of Total Maximum Daily Loads for Mountain Run and Two of its Unnamed Tributaries in Culpeper County

The Department of Environmental Quality (DEQ) seeks written and oral comments from interested persons on the development of total maximum daily loads (TMDLs) for Mountain Run and two of its unnamed tributaries in Culpeper County. The following stream segments are listed on the § 303(d) TMDL Priority List and Report as impaired due to violations of the state's water quality standards for polychlorinated biphenyls (PCBs): (i) Mountain Run in Culpeper County: 24.53 miles, from the outlet of Lake Pelham downstream to the confluence with Rappahannock River; (ii) Unnamed Tributary to Mountain Run (stream code 3-XBE) in Culpeper County: 0.6 mile from the perennial headwaters to the confluence with Mountain Run; and (iii) Unnamed Tributary to Mountain Run (stream code 3-XIH) in Culpeper County: 1.12 miles from the perennial headwaters to the confluence with Mountain Run.

Section 303(d) of the Clean Water Act and § 62.1-44.19:7 C of the Code of Virginia require DEQ to develop TMDLs for pollutants responsible for each impaired water contained in Virginia's § 303(d) TMDL Priority List and Report. A component of a TMDL is the wasteload allocation (WLA); therefore, this notice is provided pursuant to § 2.2-4006 A 14 of the Administrative Process Act for any future adoption of the TMDL WLAs.

Given the existing state of emergency related to the COVID-19 pandemic, this meeting will be held entirely virtually. A computer or a telephone is necessary to participate virtually. All meeting attendees are encouraged to access the meeting using a computer to view the meeting visuals. Attendees may also use a phone for audio and a computer for visual to avoid possible interruptions in computer audio. Although the use of a phone for audio only participation is possible, since the meeting will rely on visuals, audio only participation is discouraged. The URL to register for the virtual meeting is provided at the end of this notice. Once registered for the meeting, registrants will receive an email with the URL and telephone information to participate in the meeting. If meeting attendees experience any interruption in the meeting broadcast, they should call the technical support line that is also provided at the end of this notice.

The public comment period begins January 14, 2021, and ends February 16, 2021. A technical advisory committee (TAC) to assist in development of this TMDL will be established. Any person interested in assisting should notify the DEQ contact person by the end of the comment period and provide their name, address, phone number, email address, and the organization represented (if any). Notification of the composition of the panel will be sent to all applicants.

Proposed Enforcement Action - Lekram Investment LLC

The State Water Control Board proposes to issue a consent special order to Lekram Investment LLC for and on behalf of Hickory Hill Partners LLC, VWP Permit No. WP4-08-0535, for alleged violation of the State Water Control Law at the Hickory Hill subdivision located at 9222 Wickham Drive in Hanover County, Virginia. The State Water Control Board proposes to issue a consent order to resolve violations associated with the Chiaramonte Property.
