REGISTRAR'S NOTICE: The Marine Resources Commission is claiming an exemption from the Administrative Process Act in accordance with § 2.2-4006 A 11 of the Code of Virginia; however, the commission is required to publish the full text of final regulations.

Title of Regulation: 4VAC20-490. Pertaining to Sharks (amending 4VAC20-490-48).

Summary:

The amendment provides that the total allowable commercial landings of smooth dogfish shall be limited to a quota in dressed weight calculated pursuant to the Interstate Coastal Sharks Fishery Management Plan.

4VAC20-490-48. Smooth dogfish commercial quota and harvest limitations.

A. The annual commercial quota for smooth dogfish shall be 922,030 pounds in dressed weight. During each calendar year, total allowable commercial landings of smooth dogfish shall be limited to a quota in dressed weight calculated pursuant to the Interstate Coastal Sharks Fishery Management Plan.

B. It shall be unlawful for any person to take, harvest, or possess aboard any vessel or to land in Virginia any smooth dogfish harvested from federal waters once the National Oceanic and Atmospheric Administration (NOAA) Fisheries has determined and announced that 80% of the smooth dogfish coastwide quota has been harvested.

C. It shall be unlawful for any person to harvest or to land in Virginia any smooth dogfish for commercial purposes after the quota specified in subsection A of this section has been landed and announced as such.

D. Any smooth dogfish harvested from state waters or federal waters for commercial purposes shall only be sold to a federally permitted dealer.

E. It shall be unlawful for any buyer of seafood to receive any smooth dogfish harvested from federal waters once NOAA Fisheries has determined and announced that 80% of the smooth dogfish coastwide quota has been harvested.

F. It shall be unlawful for any buyer of seafood to receive any smooth dogfish after the commercial quota specified in subsection A of this section has been attained and announced as such.

REGISTRAR'S NOTICE: Pursuant to subdivision (6a) of § 40.1-22 of the Code of Virginia, the Safety and Health Codes Board may adopt an emergency temporary standard to take immediate effect upon publication in a newspaper of general circulation, published in the City of Richmond, Virginia, if the board determines that employees are exposed to grave danger from exposure to substances or agents determined to be toxic or physically harmful or from new hazards, and that such emergency standard is necessary to protect employees from such danger. The newspaper publication constituted notice that the board intends to adopt such standard within a period of six months. The board by similar publication shall prior to the expiration of six months give notice of the time and date of, and conduct a hearing on, the adoption of a permanent standard.

Title of Regulation: 16VAC25-220. Standard for Infectious Disease Prevention of the SARS-CoV-2 Virus that Causes COVID-19 (repealing 16VAC25-220-10 through 16VAC25-220-90).

Summary:

This action is taken pursuant to Executive Order Number Six (2022), Reinvigorating Job Growth by Removing Burdensome Regulations from Virginia's Business Community. The Safety and Health Codes Board adopted the action repealing the Virginia Standard for Infectious Disease Prevention of the SARSCoV-2 Virus That Causes COVID-19 (16VAC25-220) on March 21, 2022. The regulation being repealed provides requirements for employers to control, prevent, and mitigate the spread of SARS-CoV-2, thereby protecting employees and the general public. The Safety and Health Codes Board conducted (i) a 30-day comment period from February 17, 2022, to March 19, 2022, and (ii) a public hearing on March 14, 2022, to provide opportunity for public comment prior to the final vote to repeal the standard. The repeal is effective upon publication in the Richmond Times-Dispatch on March 23, 2022.

Notice is hereby given that the Department of Motor Vehicles is extending the public comment period regarding the proposed regulatory action published in Volume 38, Issue 11 of the Virginia Register of Regulations, January 17, 2022. The Department of Motor Vehicles proposes repealing Overload Permit Regulations (24VAC20-80) and Hauling Permit Regulation (24VAC20-82), and promulgating a new set of regulations, Overload and Hauling Permits Regulation (24VAC20-81). The proposed action consolidates the existing regulations into one new chapter to more clearly describe permitting requirements, to bring the regulations into conformity with existing law, and to incorporate procedural changes adopted to enhance efficiency and user experience. The Department of Motor Vehicles is extending the public comment period to ensure that the regulated community has received notice of the proposed regulations and has had adequate time to review the proposed regulations and respond with comments.
