Title of Regulation: 12VAC5-90. Regulations for Disease Reporting and Control (amending 12VAC5-90-80, 12VAC5-90-90).

Statutory Authority: § 32.1-35 of the Code of Virginia.

The Governor has approved the request of the State Board of Health to extend the expiration date of the emergency regulation for 12VAC5-90 for six months as provided for in § 2.2-4011 D of the Code of Virginia. Therefore, the emergency regulation is continued in effect through January 18, 2023. The proposed regulation was published in 38:12 VA.R. 1329-1340 January 31, 2022. This extension is required for the State Board of Health to continue to ensure vital disease surveillance and control information is reported to the Virginia Department of Health related to COVID-19 in compliance with the federal CARES Act requirements for disease reporting related to COVID-19. The board intends to pursue a final regulation to complete the process of making these requirements permanent. The emergency regulation was published in 37:9 VA.R. 954-961 December 21, 2020.
