Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the State Board of Health intends to consider amending 12VAC5-460, Regulations Governing Tourist Establishment Swimming Pools and Other Public Pools. The purpose of the proposed action is to update the regulation following periodic review. The intended substantive amendments and new provisions to the regulation will include updating definitions and requirements for (i) water treatment and chemical safety in storage and handling; (ii) water recirculation and entrapment prevention; (iii) signage and safety equipment; (iv) facility maintenance, including decks, rails, electrical work, and fencing; (v) management and staffing; (vi) water, sewer, and solid waste disposal; (vii) post-construction operational plan reviews, inspections, and general enforcement; and (viii) additional amendments deemed necessary.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.
