Notice of Extension of Emergency Regulation

Title of Regulation: 12VAC30-60. Standards Established and Methods Used to Assure High Quality Care (amending 12VAC30-60-5, 12VAC30-60-140).

Statutory Authority: § 32.1-325 of the Code of Virginia; 42 USC § 1396 et seq.

The Governor has approved the request of the Department of Medical Assistance Services to extend the expiration date of the emergency regulation for 12VAC30-60 for six months as provided for in § 2.2-4011 D of the Code of Virginia. Therefore, the emergency regulation is continued in effect through March 31, 2023. This extension is required for the Department of Medical Assistance Services to continue to enforcing Item 303 X 1 of Chapter 854 of 2019 Acts of Assembly, providing community mental health services in order to ensure appropriate utilization and cost efficiency and clarifying documentation requirements for service authorization for community mental health and rehabilitative services. The emergency regulation was published in 37:14 VA.R. 1549-1551 March 1, 2021.

Effective Date Extended Through: March 31, 2023.
