Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the State Board of Social Services intends to consider amending 22VAC40-73, Standards for Licensed Assisted Living Facilities. The purpose of the proposed action is to to conform the regulation to Chapter 580 of the 2023 Acts of Assembly. The amendments being considered require every assisted living facility (ALF) to maintain a minimum amount of liability insurance, as determined by the State Board of Social Services on the basis of the number of residents for which the ALF is licensed, and provide notice of such insurance, upon request, to any resident or prospective resident.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.
