Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Virginia Waste Management Board intends to consider amending 9VAC20-70, Financial Assurance Regulations for Solid Waste Disposal, Transfer and Treatment Facilities, and 9VAC20-81, Solid Waste Management Regulations. The purpose of the proposed action is to amend 9VAC20-70 to ensure that financial assurance is sufficient to cover all costs for leachate pretreatment systems, closure, post-closure care, and any necessary corrective action and remediation at a solid waste management facility. Corresponding amendments to 9VAC20-81 may also be necessary. The financial assurance criteria in Part III (9VAC20-70-80 et seq.) of 9VAC20-70 were last substantively amended 25 years ago in 2001.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.
