Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Department of Medical Assistance Services intends to consider amending 12VAC30-10, State Plan Under Title XIX of the Social Security Act Medical Assistance Program; General Provisions; 12VAC30-30, Groups Covered and Agencies Responsible for Eligibility Determination; 12VAC30-40, Eligibility Conditions and Requirements; 12VAC30-50, Amount, Duration, and Scope of Medical and Remedial Care and Services; and 12VAC30-141, Family Access to Medical Insurance Security (FAMIS) Plan. The purpose of the proposed action is to provide continuous coverage through 12 months postpartum for Medicaid and Family Access to Medical Insurance Security (FAMIS) pregnant and postpartum members and eligible individuals. A pregnant individual who is deemed eligible will maintain coverage for the duration of 12 months from the date the pregnancy ends, regardless of what point in the prenatal or postpartum period the individual enrolls in coverage. The coverage will be maintained regardless of a change in circumstances affecting income or household size.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.
