Title of Regulation: 22VAC40-680. Virginia Energy Assistance Program - Low Income Home Energy Assistance Program (LIHEAP).

Statutory Authority: § 63.2-217 of the Code of Virginia.

The State Board of Social Services has WITHDRAWN the regulatory action for 22VAC40-680, Virginia Energy Assistance Program - Low Income Home Energy Assistance Program (LIHEAP), which was published as a Notice of Intended Regulatory Action in 39:14 VA.R. 1657 February 7, 2023. The purpose of the proposed action was to extend the eligibility period for the Energy Assistance Program (EAP), add details regarding the assistance provided, and update the information regarding administrative costs for local departments of social services. As a result of recent legislative changes exempting the action from the Administrative Process Act (§ 2.2-4000 et seq. of the Code of Virginia) three-step process, the board voted on August 18, 2026, to withdraw this action. An exempt action containing these regulatory amendments is currently in process.
