TITLE 18. PROFESSIONAL AND OCCUPATIONAL LICENSING
Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Board of Pharmacy intends to consider amending 18VAC110-20, Regulations Governing the Practice of Pharmacy, 18VAC110-30, Regulations for Practitioners of the Healing Arts to Sell Controlled Substances, and 18VAC110-50, Regulations Governing Wholesale Distributors, Manufacturers, and Warehousers. The purpose of the proposed action is to increase fees to cover expenses for the essential functions of review of applications, licensing, inspections, investigation of complaints against licensees, and adjudication and monitoring of disciplinary cases required for public health and safety in the Commonwealth. Section 54.1-113 of the Code of Virginia requires that at the end of each biennium, an analysis of revenues and expenditures of each regulatory board shall be performed. It is necessary that each board have sufficient revenue to cover its expenditures. Since the fees from licensees will no longer generate sufficient funds to pay operating expenses for the Board of Pharmacy in the next biennium, consideration of a fee increase is essential. In order to have sufficient funding for the operation of the board by fiscal year 2019–2020, it is necessary to begin the process of promulgating amendments to regulations.
The agency intends to hold a public hearing on the proposed action after publication in the Virginia Register.
