STATE WATER CONTROL BOARD

Agency Notice

Pursuant to Executive Order 14 (as amended July 16, 2018) and §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the following regulation is undergoing a periodic review and a small business impact review: 9VAC25-880, General VPDES Permit for Discharges of Stormwater from Construction Activities. The review will be guided by the principles in Executive Order 14 (as amended July 16, 2018). The purpose of this review is to determine whether this regulation should be repealed, amended, or retained in its current form. Public comment is sought on the review of any issue relating to this regulation, including whether the regulation (i) is necessary for the protection of public health, safety, and welfare or for the economical performance of important governmental functions; (ii) minimizes the economic impact on small businesses in a manner consistent with the stated objectives of applicable law; and (iii) is clearly written and easily understandable.

Public comment period begins September 27, 2021, and ends October 18, 2021.

Comments must include the commenter's name and address (physical or email) information in order to receive a response to the comment from the agency. Following the close of the public comment period, a report of both reviews will be posted on the Virginia Regulatory Town Hall and published in the Virginia Register of Regulations.

Agency Notice

Pursuant to § 2.2-4007.1 of the Code of Virginia, the State Water Control Board is conducting a periodic review and a small business impact review of 9VAC25-890, General VPDES Permit for Discharges of Stormwater from Small Municipal Separate Storm Sewer Systems (formerly Part XV, 4VAC50-60). The review of this regulation will be guided by the principles in Executive Order 14 (as amended, July 16, 2018).

The Notice of Intended Regulatory Action for 9VAC25-890, which is published in this issue of the Virginia Register, serves as the announcement of the periodic review.

TITLE 18. PROFESSIONAL AND OCCUPATIONAL LICENSING

BOARD OF PSYCHOLOGY

Report of Findings

Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the Board of Psychology conducted a periodic review and a small business impact review of 18VAC125-15, Regulations Governing Delegation to an Agency Subordinate, and determined that this regulation should be retained in its current form. The department is publishing its report of findings dated August 31, 2021, to support this decision.

The Regulatory Committee reviewed the regulation and noted that it is mandated by the law. The board voted on August 31, 2021, to retain the regulation without amendment. While the board has not yet delegated cases to an agency subordinate, it is anticipated that agency subordinates may be utilized to conduct informal fact-finding proceedings, so the regulation is necessary for public health, welfare, and safety to retain the regulation as written.

The regulation is necessary for public protection since there is a statutory mandate for licensure in subdivision 10 of § 54.1-2400 of the Code of Virginia. Criteria for the appointment of an agency subordinate shall be set forth in regulations adopted by the board. There have been no comments or complaints. The regulation was promulgated in 2004 as an emergency regulation that became effective in 2005. It was reviewed in 2012 for clarity and for ease of understanding with an amendment to 18VAC125-15-20. This regulation does not overlap, duplicate, or conflict with state or federal law. This regulation has no impact on small businesses.
