CRIMINAL JUSTICE SERVICES BOARD

Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the Criminal Justice Services Board conducted a periodic review and a small business impact review of 6VAC20-20. Rules Relating to Compulsory Minimum Training Standards for Law-Enforcement Officers, and determined that this regulation should be amended. The proposed regulation, which is published in Volume 41, Issue 8, VA.R. 971, serves as the report of findings.

TITLE 8. EDUCATION

STATE BOARD OF EDUCATION

Report of Findings

Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the State Board of Education conducted a periodic review and a small business impact review of 8VAC20-441, Regulations Governing the Employment of Professional Personnel, and determined that this regulation should be amended. The board is publishing its report of findings dated August 28, 2025, to support this decision.

This chapter is clearly written and easily understood; remains necessary for the protection of public health, safety, and welfare; and is required by statute. The regulation will be amended for clarity and to conform with the Code of Virginia. This regulation was promulgated in 2017. . The regulation will be amended to reflect the statutory changes since then. There is a continued need for the regulation. No complaints or comments were received concerning the regulation. The regulation is not overly complex and does not overlap, duplicate, or conflict with federal or state law. This regulation has not been affected by changes in technology, economic conditions, or other factors since the chapter was promulgated in 2017. 8VAC20-441-50 was amended in 2020. There is no impact on small business from this regulation.

Report of Findings

Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the State Board of Education conducted a periodic review and a small business impact review of 8VAC20-560, Regulations Governing Reporting of Acts of Violence and Substance Abuse in Schools, and determined that this regulation should be amended. The board is publishing its report of findings dated August 28, 2025, to support this decision.

This regulation is clearly written and easily understood; remains necessary for the protection of public health, safety, and welfare; and is required by statute. The regulation was promulgated in 1992. Since that time, § 22.1-280.1 of the Code of Virginia was repealed by Chapters 688 and 820 of the 2001 Acts of Assembly, and the statutory requirements were replaced in § 22.1-279.3:1 of the Code of Virginia by Chapters 793 and 794 of the 2022 Acts of Assembly. The regulation will be updated to conform to statute.

There is a continued need for the regulation. No complaints or comments were received concerning the regulation. The regulation is not overly complex and does not overlap, duplicate, or conflict with federal or state law. This regulation has not been affected by changes in technology, economic conditions, or other factors since the chapter was promulgated in 1992.

Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the State Board of Education conducted a periodic review and a small business impact review of 8VAC20-660, Regulations Governing the Reenrollment of Students Committed to the Department of Juvenile Justice, and determined that this regulation should be amended. The board is publishing its report of findings dated August 28, 2025, to support this decision.

This regulation is necessary for the protection of public health, safety, and welfare in that it provides regulations governing the re-enrollment of students committed to the Department of Juvenile Justice. The regulation seeks to ensure that court-involved students receive the necessary resources in order to safely and effectively re-enroll the students into a public school. The regulation will be amended to update terminology, adjust timelines, enhance clarity, and align with changes in practices at the Department of Juvenile Justice that have made a larger number of pre-dispositional youth eligible for re-enrollment plans.

At this time, the Department of Education has received no comments concerning the regulation and is unaware of any complaints. There is no known overlap between the regulation and any other state or federal law or regulation. The regulation has not been amended since it became effective on August 23, 2006. The agency's decision to amend the regulation will have no impact on small businesses.

The board is publishing its report of findings dated August 28, 2025, to support this decision.

This regulation is clearly written and easily understood; remains necessary for the protection of public health, safety, and welfare; and is required by statute. The regulation will be updated to include Residential Child Care Institutions and to conform to federal requirements at 7 CFR 210.11(c)(2)(i-v) and 7 CFR 210.11 and to statutory changes to§ 22.1-207.4 of the Code of Virginia.

There is a continued need for the regulation. No complaints or comments were received concerning the regulation. The regulation is not overly complex and does not overlap, duplicate, or conflict with federal or state law. This regulation has not been affected by changes in technology, economic conditions or other factors since the chapter was promulgated in 2017. 8VAC20-740-10 was amended in 2025. There is no impact on small business from this regulation.

Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the Commonwealth Transportation Board conducted a periodic review and a small business impact review of 24VAC30-50, Rules and Regulations for the Administration of Waysides and Rest Areas, and 24VAC30-100, Rules and Regulations for the Administration of Parking Lots and Environs, and determined that these regulations should be repealed. The proposed regulation, which is published in this issue of the Virginia Register, serves as the report of findings.
