TITLE 9. ENVIRONMENT
VIRGINIA WASTE MANAGEMENT BOARD
Report of Findings
Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the Virginia Waste Management Board conducted a periodic review and a small business impact review of 9VAC20-30, Technical Assistance Fund Administrative Procedures, and determined that this regulation should be retained as is. The board is publishing its report of findings dated September 22, 2026, to support this decision.
This regulation is necessary for the protection of public health, safety, and welfare because it sets forth the process for a community hosting a hazardous waste facility to obtain technical assistance funds, including a thorough and efficient review by the host community’s local government regarding the impact from the proposed hazardous waste facility to public health, safety, and welfare.
The regulation is clearly written and easily understandable. This regulation is effective and continues to be needed. No change is necessary to keep this regulation effective or improve its function, which is why the regulation is being retained as is. No public comments were received during the public comment period. This regulation does not overlap, duplicate, or conflict with any state law or other state regulation. This regulation is mandated by Virginia statute to establish a procedure for siting of hazardous waste management facilities, including certification of the site, investigation of the site, resolution of issues between the applicant and the host community, and funding the process.
A periodic review of this regulation was last conducted in 2020, and the regulation remains current. Small businesses are not impacted by this regulation.

Report of Findings
Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the Virginia Waste Management Board conducted a periodic review and a small business impact review of 9VAC20-40, Administrative Procedures for Hazardous Waste Facility Site Certification, and determined that this regulation should be retained as is. The board is publishing its report of findings dated September 22, 2026, to support this decision.
This regulation is necessary for the protection of public health, safety, and welfare because it establishes administrative procedures for the submission and evaluation of applications for certification of hazardous waste facility sites, including the processing of applications and public notice requirements.
This regulation is technical in nature and is clearly written and easily understandable. The regulation is effective and continues to be needed. No change is necessary to keep this regulation effective or improve its function, which is why the regulation is being retained as is. No public comments were received during the public comment period. A periodic review of this regulation was last conducted in 2020, and the regulation remains current. As the regulation is narrowly tailored to the establishment of hazardous waste facility siting procedures, the Department of Environmental Quality has determined that the regulatory requirements currently minimize the economic impact of this regulation on small businesses while meeting the requirements of state law.

TITLE 18. PROFESSIONAL AND OCCUPATIONAL LICENSING
BOARD OF NURSING
Report of Findings
Pursuant to §§ 2.2-4007.1 and 2.2-4017 of the Code of Virginia, the Board of Nursing conducted a periodic review and a small business impact review of 18VAC90-60, Regulations Governing the Registration of Medication Aides, and determined that this regulation should be amended. The board is publishing its report of findings dated September 22, 2026, to support this decision.
The regulation is necessary for the protection of public health, safety, and welfare because the General Assembly has directed the board to regulate medication aides and this chapter does so. The regulation is clearly written and easily understandable, but changes to wording and structure are being considered as a result of this periodic review. Board staff have identified some changes that should be made to the regulation, and a panel of the board will consider those recommendations. The regulation continues to be needed as the board continues to be required to regulate the profession. The comments express frustration with particular requirements of the regulation, which will be considered as the board reviews recommendations from staff. The regulation is not overly complex; however, there may be room for simplifying some of the language to make it easier to understand. The regulation supplements, but does not overlap, federal law and regulation regarding medication aides. This regulation has not been reviewed since 2019, in which time many changes to technology, economic conditions, and other factors have occurred. The decision to amend will likely not impact small businesses.
