Statutory Authority: §§ 54.1-2400 and 54.1-3223 of the Code of Virginia.

Name of Petitioner: Weston Pack.

Nature of Petitioner's Request: To add an investigative ophthalmic drop to the approved formulary of drugs that may be prescribed by an optometrist.

Agency Decision: Request denied.

Statement of Reason for Decision: At its meeting on July 16, 2021, the board voted to deny the petition based on information that the drug requested is not yet approved by the Food and Drug Administration (FDA) for the particular use in optometric practice. The board will continue to monitor the process and will consider the initiation of a regulatory process when FDA approval is given.
