Administration of Medical Assistance Services
Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Board of Medical Assistance Services intends to consider amending 12VAC30-20, Administration of Medical Assistance Services. The purpose of the proposed action is to comply with Item 307 III of Chapter 3 of the 2012 Acts of Assembly, Special Session I, which authorizes the Department of Medical Assistance Services (DMAS) to promulgate regulations to implement changes related to appeals administered by and for the department. The amendments will address DMAS timelines and specifications for filing required documentation, including the sufficiency of the contents of case summaries, and will clarify DMAS' authority to administratively invalidate untimely filed appeals.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.

Methods and Standards for Establishing Payment Rates; Other Types of Care
Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Board of Medical Assistance Services intends to consider amending 12VAC30-80, Methods and Standards for Establishing Payment Rates; Other Types of Care. The purpose of the proposed action is to implement a prospective payment methodology for outpatient hospital services and to maintain reimbursement of drug rebates for outpatient hospital services. The current cost-based methodology is out of date, inefficient, and costly. The Department of Medical Assistance Services (DMAS) is proposing to implement the Enhanced Ambulatory Patient Group (EAPG) reimbursement methodology as authorized by Item 307 XX of Chapter 806 of the 2013 Acts of Assembly. The EAPG reimbursement methodology is deemed to be a more efficient and predictable reimbursement methodology for DMAS to pay hospitals that furnish services to Medicaid recipients in an outpatient hospital setting.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Board of Medical Assistance Services has WITHDRAWN the Notice of Intended Regulatory Action for 12VAC30-120, Waivered Services, which was published in 24:20 VA.R. 2836 June 9, 2008. This action is being withdrawn as the agency has determined that this action is no longer relevant or necessary.

Regulations Governing the Practice of Physician Assistants
Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Board of Medicine intends to consider amending 18VAC85-50, Regulations Governing the Practice of Physician Assistants. The purpose of the proposed action is to establish the education, experience, and examination requirements for physician assistants to perform fluoroscopy, in accordance with Chapter 81 of the 2012 Acts of Assembly.

The agency intends to hold a public hearing on the proposed action after publication in the Virginia Register.
