Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the State Board of Health intends to consider promulgating 12VAC5-660, Regulations Governing Biological Sex Specific or Separated Spaces and Activities. The purpose of the proposed action is to to promulgate a new regulation governing gender-specific spaces and activities. The regulatory action is a result of a petition for rulemaking (41:19 VA.R. 2039 May 5, 2025). The State Board of Health approved such regulatory action August 18, 2025. The purpose of this action is to establish requirements for preventing biological males from (i) participation in organized female-only athletic teams and competitions and (ii) use of female-designated spaces where females are likely to be in any state of undress.

The agency intends to hold a public hearing on the proposed action after publication in the Virginia Register.

Withdrawal of Notice of Intended Regulatory Action

Title of Regulation: 22VAC40-325. Fraud Reduction/Elimination Effort (amending 22VAC40-325-10, 22VAC40-325-20).

Statutory Authority: §§ 63.2-217 and 63.2-526 of the Code of Virginia.

Notice is hereby given that the State Board of Social Services has WITHDRAWN the Notice of Intended Regulatory Action for 22VAC40-325, Fraud Reduction/Elimination Effort, that was published in 41:16 VA.R. 1729 March 24, 2025. The purpose of the proposed action was to rename the Fraud Reduction/Elimination Effort as the Statewide Fraud Control Program and change the methodology used to reimburse local departments of social services. Changes being considered would have moved away from a formula for reimbursement rates that is caseload based to one that reflects actual fraud work. The state board voted on October 15, 2025, to withdraw this NOIRA and submit a new NOIRA later this year.

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Department of Transportation intends to consider repealing 24VAC30-120, Rules and Regulations Controlling Outdoor Advertising and Directional and Other Signs and Notices, and promulgating 24VAC30-122, Regulations Controlling Outdoor Advertising and Other Signs and Notices. The purpose of the proposed action is to undertake a comprehensive review of 24VAC30-120. This regulation establishes provisions for the placement and characteristics of outdoor advertising and signs consistent with requirements of federal law and regulation. The intent of this action is to remove redundant or obsolete language and identify opportunities for regulatory streamlining. The proposed action would repeal 24VAC30-120 and replace it with a new chapter at 24VAC30-122.

In addition, pursuant to § 2.2-4007.1 of the Code of Virginia, the agency is conducting a periodic review and small business impact review of this regulation to determine whether this regulation should be terminated, amended, or retained in its current form. Public comment is sought on the review of any issue relating to this regulation, including whether the regulation (i) is necessary for the protection of public health, safety, and welfare; (ii) minimizes the economic impact on small businesses consistent with the stated objectives of applicable law; and (iii) is clearly written and easily understandable.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.
