    Proposed State Implementation Plan Revision
    Notice of action: The Department of Environmental Quality (DEQ)  is announcing an opportunity for public comment on a proposed revision to the  Commonwealth of Virginia State Implementation Plan (SIP). The SIP is a plan  developed by the Commonwealth in order to fulfill its responsibilities under  the federal Clean Air Act to attain and maintain the ambient air quality  standards promulgated by the U.S. Environmental Protection Agency (EPA) under  the Act. The Commonwealth intends to submit the regulation to EPA as a revision  to the SIP in accordance with the requirements of § 110(a) of the federal  Clean Air Act.
    Regulations affected: The regulation of the board affected by  this action is as follows: 9VAC5-85-50 of Part III of 9VAC5-85 (Permits for  Stationary Sources of Pollutants Subject to Regulation).
    Purpose of notice: DEQ is seeking comment on the issue of  whether the regulation amendments should be submitted as a revision to the SIP.
    Public comment period: October 24, 2011, to November 23, 2011.
    Public hearing: A public hearing may be conducted if a request  is made in writing to the contact listed below. In order to be considered, the  request must include the full name, address, and telephone number of the person  requesting the hearing and be received by DEQ by the last day of the comment  period. Notice of the date, time, and location of any requested public hearing  will be announced in a separate notice, and another 30-day comment period will  be conducted.
    Public comment stage: The regulation amendments are exempt from  the state administrative procedures for adoption of regulations contained in  Article 2 of the Administrative Process Act by the provisions of § 2.2-4006  A 4 c of the Administrative Process Act because they are necessary to meet the  requirements of the federal Clean Air Act and do not differ materially from the  pertinent EPA regulations. Since the amendments are exempt from administrative  procedures for the adoption of regulations, DEQ is accepting comment only on  the issue cited above under "purpose of notice" and not on the  content of the regulation amendments.
    Description of proposal: On July 20, 2011 (76 FR 43490), EPA  promulgated final amendments to its regulations for permitting of greenhouse  gases (GHGs). The purpose of the amendments is to defer, for a three year  period, the application of the prevention of significant deterioration (PSD)  and federal operating (Title V) permitting requirements to carbon dioxide (CO2)  emissions from bioenergy and other biogenic stationary sources in order for EPA  to conduct a detailed examination of the science associated with biogenic CO2.  The amendments affect the PSD NSR regulations in 40 CFR 51.166 by revising  the definition of "subject to regulation." Because Virginia has the  authority to directly implement federal PSD regulations as long as its rules  are at least as protective as the federal, the corresponding Virginia  regulation must be revised accordingly when a final federal rule is  promulgated.
    Federal information: This notice is being given to satisfy the  public participation requirements of federal regulations (40 CFR 51.102)  and not any provision of state law. Except as noted below, the proposal will be  submitted as a revision to the Commonwealth of Virginia SIP under § 110(a)  of the federal Clean Air Act in accordance with 40 CFR 51.104. It is planned to  submit all provisions of the proposal as a revision to the Commonwealth of  Virginia SIP with the exception of Part II, which contains federal operating  permit program provisions not germane to the SIP, and is provided in the  submittal for information only.
    How to comment: DEQ accepts written comments by email, fax, and  postal mail. In order to be considered, comments must include the full name,  address, and telephone number of the person commenting and be received by DEQ by  the last day of the comment period. Commenters submitting faxes are encouraged  to provide the signed original by postal mail within one week. All testimony,  exhibits, and documents received are part of the public record.

    DEPARTMENT OF ENVIRONMENTAL QUALITY
    Proposed Consent Special Order for DuPont Teijin Films U.S.  Limited Partnership
    An enforcement action has been proposed for DuPont Teijin Films  U.S. Limited Partnership for alleged violations at DuPont Teijin Films,  Hopewell Site at 3600 Discovery Drive, Chesterfield, VA. The State Water  Control Board proposes to issue a consent special order to DuPont Teijin Films  U.S. Limited Partnership to address noncompliance with State Water Control  Board law.     Notice of Public Meeting and Public  Comment for Upper Banister River
    The Department of Environmental Quality (DEQ) and the  Department of Conservation and Recreation (DCR) seek written and oral comments  from interested persons on the development of an Implementation Plan (IP) for  bacteria total maximum daily loads (TMDLs) on a 11.67 miles segment of the  Upper Banister River, 9.31 miles of Bearskin Creek, 8.44 miles of Cherrystone  Creek, 8.99 miles of Stinking Creek, and 0.82 miles of Whitethorn Creek in  Pittsylvania County and the Towns of Chatham and Gretna. The TMDLs for these  stream impairments were completed in November 2007, and can be found in the  Banister River Report on DEQ's website at http://www.deq.virginia.gov/tmdl/apptmdls/rapprvr/urappaec.pdf.
    Section 62.1-44.19:7 C of the Code of Virginia requires the  development of an IP for approved TMDLs. The IP should provide measurable goals  and the date of expected achievement of water quality objectives. The IP should  also include the corrective actions needed and their associated costs,  benefits, and environmental impacts.  
    The second public meeting on the development of the IP for the  bacteria TMDLs will be held on Tuesday, October 25, 2011, at 7 p.m. at the  Old Dominion Agricultural Complex and Farm Services Agency office at 19783 U.S. Hwy 29, Chatham, Virginia. At this meeting, the draft implementation plan to  restore water quality in the Upper Banister River and tributaries will be  presented to the public.
    The 30-day public comment period on the draft implementation  plan presented at this meeting will end on November 25, 2011. A fact sheet on  the development of the IP for the Upper Banister River and tributaries is  available upon request.     DEPARTMENT OF MEDICAL ASSISTANCE SERVICES
    Supplemental Payments for Certain Private Hospitals -- Notice  of Intent to Amend the Virginia State Plan for Medical Assistance (pursuant to  § 1902(a)(13) of the Act (USC 1396a(a)(13))
    The Virginia Department of Medical Assistance Services (DMAS)  hereby affords the public notice of its intention to amend the Virginia State  Plan for Medical Assistance to make supplemental payments for certain private  hospitals for inpatient and outpatient services and for certain nursing  facilities for specialized care services.
    Effective the day after publication of this notice, Virginia  plans to make supplemental payments for eligible private hospitals for  inpatient and outpatient services and for eligible nursing facilities for  nursing facility services. Eligible facilities are those that have signed a  collaborative agreement with a state or local government entity or who have  partnered with a state-owned teaching hospital. Supplemental payments shall be  calculated by subtracting regular payments from total charges. Payments will be  subject to upper payment limits for all private facilities as a class for each  of the service categories as described in 42 CFR 447.272 and 42 CFR 447.321. Payments  to DSH hospitals will be subject to the DSH limit described in Section  1923(g)(1)(A) of the Social Security Act. DMAS estimates making annual  supplemental payments of $20 million to hospitals who have signed a  collaborative agreement with a state or local government entity and $9 million  to hospitals and nursing facilities who have partnered with a state-owned  teaching hospital.     Filing Material for Publication in the Virginia Register of  Regulations: Agencies are required to use the Regulation Information System  (RIS) when filing regulations for publication in the Virginia Register of  Regulations. The Office of the Virginia Register of Regulations implemented  a web-based application called RIS for filing regulations and related items for  publication in the Virginia Register. The Registrar's office has worked closely  with the Department of Planning and Budget (DPB) to coordinate the system with  the Virginia Regulatory Town Hall.
