Response to Public Comment on Guidance for Cyanobacteria Bloom Recreational Advisory Management
The Virginia Department of Health (VDH) thanks the public for its comment on the VDH guidance document, Guidance for Cyanobacteria Bloom Recreational Advisory Management. The public comment period ended on May 21, 2025. VDH has reviewed all of the comments submitted on the Virginia Regulatory Town Hall, including comments submitted in emails to VDH staff.
Under the new proposed guidance, VDH will now issue a recreational advisory when toxin concentrations are exceeded and will no longer be using cell counts to issue advisories for harmful algal blooms (HAB). This decision is based on an extensive data review and review of other state protocols and is consistent with Environmental Protection Agency (EPA) Recommended recommended Human Health Recreational Ambient Water Quality Criteria or Swimming Advisories for Microcystins and Cylindrospermposin, which can be found at https://www.epa.gov/wqc/recreational-water-quality-criteria-and-methods.
The change in approach is also supported by the existing data collected in Virginia inland waterways from 2020 to 2024, which show that elevated cell densities do not indicate there is an unsafe level of toxin. The guidance change facilitates more efficient investigations by the Virginia Department of Environmental Quality (DEQ) and VDH and quicker receipt of results from the Department of General Services Division of Consolidated Lab Services (DCLS) in a timelier manner. The change should also reduce the uncertainty in public health messaging and advisories. The public will know if toxins are present in waters, and advisories will be issued when toxins exceed VDH and EPA safe swimming thresholds. Overall, toxin testing provides a more reliable and direct assessment of the risks associated with HABs.
This guidance change will neither reduce nor limit the response to HAB reports. VDH will continue to collect and consider all potential HAB reports. DEQ will continue to focus monitoring efforts in areas with high recreation and known blooms, will investigate potential algal blooms more extensively, and will collect more samples during each investigation. Increased sampling will result in more comprehensive investigations, with sampling both in areas that are representative of larger water body segments and in areas where blooms are densest and where toxins may exist.
Although advisories will be based on toxins only, VDH will consider any type of information about a potential HAB and may use it to alert the public that a bloom might be present, or to help communities develop such alerts for waterways. Even if a HAB has not been confirmed, if water is discolored, murky, has an odor, or appears to have a film on the surface, humans and pets should stay out of the water.

Board of Housing and Community Development Public Hearing Notice
Pursuant to subdivision A 12 of § 2.2-4006 and § 36-100 of the Code of Virginia, the Board of Housing and Community Development will hold a public hearing on the Virginia Amusement Device Regulations (13VAC5-31), Virginia Statewide Fire Prevention Code (13VAC5-52), Virginia Uniform Statewide Building Code (13VAC5-63), and the Virginia Industrialized Building Safety Regulations (13VAC5-91).
At the public hearing, the board will also receive comments regarding the Virginia Certification Standards (13VAC5-21) and the Virginia Manufactured Home Safety Regulations (13VAC5-95). Public hearings regarding these two regulations will also be held after publication of the proposed regulations as stated in the respective Notices of Intended Regulatory Action.
The purpose of the public hearing is to take public comment on updating the codes to the newest editions of the model codes and standards prior to the board publishing the proposed regulations.

In accordance with the 2025 Appropriations Act, DMAS will be making the following changes:
Methods and Standards for Establishing Payment Rates; In-Patient Hospital Care (12VAC30-70)
In accordance with Item 288 MMMMM of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to include a provision for payment of medical assistance for Food and Drug Administration (FDA) approved long-acting injectable or extended-release medications administered for a serious mental illness or substance use disorder in any hospital inpatient setting. This payment shall be unbundled from the hospital rate.
There are no expected increases or decreases in annual fee-for-service aggregate expenditures in federal fiscal year 2025 or federal fiscal year 2026.
In accordance with Item 288 RRRRR of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to make supplemental payments through an adjustment to the formula for indirect medical education (IME) reimbursement, using managed care discharge days, not to exceed $30 million total computable for teaching hospitals affiliated with Virginia Tech Carilion School of Medicine. The public entity shall transfer the nonfederal share of the authorized supplemental payments. The funds to be transferred must comply with 42 CFR 433.51 and 433.54. Such funds may not be paid from any private agreements with Virginia Tech Carilion School of Medicine that are in excess of fair market value or that alleviate pre-existing financial burdens of the school. The Virginia Tech Carilion School of Medicine is authorized to use general fund dollars to accomplish this transfer. The Virginia Tech Carilion School of Medicine would enter into an Interagency Agreement with the department for this purpose and must attest to compliance with applicable CMS criteria.
There are no expected increases or decreases in annual fee-for-service aggregate expenditures in federal fiscal year 2025. The expected increase in annual fee-for-service aggregate expenditures is $8,297,630 in state general funds and $21,702,370 in federal funds in federal fiscal year 2026.
In accordance with Item 3-5.15 of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to broaden the types of hospitals that qualify for supplemental payments for in-patient services to Medicaid patients. Specifically, all private hospitals will include critical access hospitals. The provider rate assessment is used to fund the state general fund of the hospital supplemental payments and the change in the way a private hospital is defined will increase the number of hospitals participating in the assessment.
There are no expected increases or decreases in annual fee-for-service aggregate expenditures in federal fiscal year 2025. The expected increase in annual fee-for-service aggregate expenditures is $308,224 in state general funds and $621,882 in federal funds in federal fiscal year 2026.

In accordance with Item 288 FFFFF 2 of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to update the rates for private duty and skilled nursing under the Early Periodic Screening, Diagnosis, and Treatment (EPSDT) benefit by 3.0%. A corresponding rate increase will be provided for these services and for group homes, sponsored residential, supported living, independent living supports, in-home supports, community engagement, community coaching, therapeutic consultation, group day support, group supported employment, workplace assistance, community guide, and benefits planning provided under home and community-based waivers. These increases are not included in the state plan amendment, but via waiver documentation.
The expected increase in annual fee-for-service aggregate expenditures is $16,490 in state general funds and $17,154 in federal funds in federal fiscal year 2025, and $100,995 in state general funds and $103,199 in federal funds in federal fiscal year 2026.
In accordance with Item 288 GGGGG 2 of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to increase the rates for agency-directed and consumer-directed personal care under EPSDT benefit by 2.0%. A corresponding rate increase of 2.0% will be provided for these services and for companion and respite services provided under home and community-based waivers; however, the increase is not included in a state plan amendment, but via waiver documentation.
The expected increase in annual fee-for-service aggregate expenditures is $109 in state general funds and $112 in federal funds in federal fiscal year 2025, and $660 in state general funds and $673 in federal funds in federal fiscal year 2026.
In accordance with Item 288 MMMMM of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to include a provision for payment of medical assistance for Federal Drug Administration (FDA) approved long-acting injectable or extended-release medications administered for a serious mental illness or substance use disorder in any hospital emergency department. This payment shall be unbundled from the hospital rate.
The expected increase in annual fee-for-service aggregate expenditures is $841 in state general funds and $1,980 in federal funds in federal fiscal year 2025, and $3,372 in state general funds and $7,939 in federal funds in federal fiscal year 2026.
In accordance with Item 288 PPPPP of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to ensure that the reimbursement for a service provided by a licensed certified midwife or licensed midwife shall be in the same amount as the Medicaid reimbursement paid to a licensed physician or certified nurse midwife, whichever is higher, for performing such service in the area served.
The expected increase in annual fee-for-service aggregate expenditures is $2,713 in state general funds and $3,554 in federal funds in federal fiscal year 2025, and $10,850 in state general funds and $14,215 in federal funds in federal fiscal year 2026.
In accordance with Item 288 UUUUU of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to increase the rates by 6.5% for office-based addiction treatment, opioid treatment services, partial hospitalization services, and intensive outpatient services.
The expected increase in annual fee-for-service aggregate expenditures is $6,177 in state general funds and $23,430 in federal funds in federal fiscal year 2025, and $35,208 in state general funds and $133,554 in federal funds in federal fiscal year 2026.
In accordance with Item 288 WWWWW of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to provide supplemental payments for dentists employed by or contracted with the Virginia Commonwealth University School of Dentistry. The total supplemental payment shall be based on the average commercial rate as approved by the federal Centers for Medicare and Medicaid Services (CMS) and all other Medicaid payments subject to such limit made to such dentists. DMAS shall enter into a transfer agreement with Virginia Commonwealth University for such supplemental payments, in which the university shall provide the nonfederal share in order to match federal Medicaid funds for the supplemental payments.
There are no expected increases or decreases in annual fee-for-service aggregate expenditures in federal fiscal year 2025. The expected increase in annual fee-for-service aggregate expenditures is $854,417 in state general funds and $1,712,833 in federal funds in federal fiscal year 2026.
In accordance with Item 3-5.15 of Chapter 725 of the 2025 Acts of Assembly, Special Session I, DMAS is revising the state plan to broaden the types of hospitals that qualify for supplemental payments for outpatient services to Medicaid patients. Specifically, all private hospitals will include critical access hospitals. The provider rate assessment is used to fund the state general fund of the hospital supplemental payments and the change in how private hospitals is defined will increase the number of hospitals participating in the assessment.
There are no expected increases or decreases in annual fee-for-service aggregate expenditures in federal fiscal year 2025. The expected increase in annual fee-for-service aggregate expenditures is $1,361,651 in state general funds and $2,747,310 in federal funds in federal fiscal year 2026.
