Public Meeting and Opportunity for Public Comment on the Development of a Cleanup Plan for Back Creek, Eidson Creek, and Jennings Branch in Augusta County, Virginia
Purpose of notice: The Department of Environmental Quality (DEQ) seeks public comment on the development of a cleanup study, also known as a total maximum daily load (TMDL) report, for Back Creek, Eidson Creek, and Jennings Branch in Augusta County, Virginia. These streams are listed as impaired since monitoring data does not meet Virginia's water quality standards for aquatic life (benthic impairment). Section 303(d) of the federal Clean Water Act and § 62.1-44.19:7 C of the Code of Virginia require DEQ to develop cleanup studies to address pollutants responsible for causing waters to be on Virginia's § 303(d) list of impaired waters. A component of a cleanup study is the wasteload allocation (WLA); therefore, this notice is provided pursuant to § 2.2-4006 A 14 of the Code of Virginia for adoption of the WLA into the Water Quality Management Planning Regulation (9VAC25-720) after completion of the study. The adoption of the WLA may require new or additional requirements for entities holding a Virginia Pollutant Discharge Elimination System (VPDES) permit in these watersheds.
A study has been completed for Back Creek, Eidson Creek, and Jennings Branch to identify pollutant sources and recommend reductions needed from the sources to meet water quality standards. At the meeting, DEQ will present the results of the study and provide an overview of the draft report. Citizens are invited to provide comment on the study.
Cleanup study location: The cleanup study addresses the following impaired stream segments: Back Creek, located in Augusta County, is impaired from its headwaters, located south of Middlebrook, to its confluence with Middle River 10.7 miles downstream. Eidson Creek, also located in Augusta County, is impaired from its headwaters north of Middlebrook to its confluence with Middle River 8.9 miles downstream. The benthic impairment on Jennings Branch extends from its confluence with McKittricks Branch 4.1 miles downstream to its confluence with Middle River.
TMDL community engagement meetings: TMDL community engagement meetings to assist in development of this cleanup study were convened June 15, 2026, and September 2, 2026.
Public meeting: The final public meeting on the development of the cleanup study will be held October 26, 2026, at 5:30 p.m. at the Middlebrook Community Center, 54 Cherry Grove Road, Middlebrook, VA 24459. In the event of inclement weather, the meeting will be held October 28, 2026, at 5:30 p.m. at the DEQ Valley Regional Office, 4411 Early Road, Harrisonburg, VA 22801.
Public comment period: October 26, 2026, to November 30, 2026.
How to comment: DEQ accepts written comments by email or postal mail. All comments must be received by DEQ during the comment period. Submittals must include the name, organization represented (if any), mailing address, and telephone number of the commenter or requester.
Contact Information: Nesha McRae, Department of Environmental Quality, Valley Regional Office, 4411 Early Road, Harrisonburg, VA 22801, telephone (540) 217-7173, or email nesha.mcrae@deq.virginia.gov.
Opportunity for Public Comment on Air Quality State Implementation Plan Revision C26
Notice of action: The Department of Environmental Quality (DEQ) is announcing an opportunity for public comment on a proposed revision to the Commonwealth of Virginia State Implementation Plan (SIP). The SIP is a plan developed by the Commonwealth in order to fulfill its responsibilities under the federal Clean Air Act to attain and maintain the ambient air quality standards promulgated by the U.S. Environmental Protection Agency (EPA) under the federal Clean Air Act. The Commonwealth intends to submit the regulation to EPA as a revision to the SIP in accordance with the requirements of § 110(a) of the federal Clean Air Act.
Regulations affected: The regulation of the board affected by this action is Emission Standards for Stationary Sources Subject to Case-by-Case RACT Determinations, Article 51 of Existing Stationary Sources (9VAC5-40), Revision C26.
Purpose of notice: DEQ is seeking comment on the issue of whether the regulation amendments should be submitted as a revision to the SIP.
Public comment period: October 19, 2026, to November 18, 2026.
Public hearing: A public hearing will be held November 16, 2026, at 1 p.m. at the DEQ Northern Regional Office, Conference Room One, 13901 Crown Court, Woodbridge, VA 22193.
Public comment stage: The regulation amendments are exempt from state administrative procedures for adoption of regulations contained in Article 2 of the Administrative Process Act by the provisions of § 2.2-4006 A 4 c of the Code of Virginia because they are necessary to meet the requirements of the federal Clean Air Act and do not differ materially from the pertinent EPA regulations. Since the amendments are exempt from administrative procedures for the adoption of regulations, DEQ is accepting comment only on the issue cited under "purpose of notice" and not on the content of the regulation amendments.
Description of proposal: The proposed revision consists of adding new requirements for the case-by-case determination of reasonably available control technology (RACT) needed in order to meet the EPA 0.070 parts per million (ppm) National Ambient Air Quality Standard (NAAQS) for ozone. On December 6, 2018 (83 FR 62998), EPA amended Subpart CC to 40 CFR Part 51, which covers the implementation of the 2015 eight-hour ozone standard. The Northern Virginia Ozone Moderate Nonattainment Area and Stafford County, which correspond to the Northern Virginia Volatile Organic Compound (VOC) and Nitrogen Oxides (NOX) Emissions Control Areas, and which are part of the Ozone Transport Region (OTR), must meet the RACT requirements of 40 CFR 51.1316. This section of the EPA rule specifies dates by which RACT must be implemented in the OTR. The state regulations must be consistent with the federal regulations in order for the state to continue to implement RACT.
Federal information: This notice is being given to satisfy the public participation requirements of federal regulations (40 CFR 51.102) and not any provision of state law. The proposal will be submitted as a revision to the Commonwealth of Virginia SIP under § 110(a) of the federal Clean Air Act in accordance with 40 CFR 51.104. It is planned to submit all provisions of the proposal as a revision to the SIP.
How to comment: DEQ accepts written comments by email and postal mail. In order to be considered, comments must include the full name, address, and telephone number of the person commenting and be received by DEQ by the last day of the comment period. All materials received are part of the public record.
To review regulation documents: The proposal is available on the DEQ Air Public Notices for Plans website at https://www.deq.virginia.gov/news-info/shortcuts/public-notices/air. The documentation may also be obtained by contacting the DEQ representative listed. The public may review the documents between 8:30 a.m. and 4:30 p.m. of each business day until the close of the public comment period at the following DEQ locations:
1. Central Office, 22nd Floor, 1111 East Main Street, Richmond, VA 23219, telephone (804) 698-4000; and
2. Northern Regional Office, 13901 Crown Court, Woodbridge, VA 22193, telephone (703) 583-3800.
Contact Information: Julia Wack, Policy Analyst, Office of Air Data Analysis and Planning, Department of Environmental Quality, P.O. Box 1105, Richmond, VA 23218, telephone (804) 432-3581, or email julia.n.wack@deq.virginia.gov.
DEPARTMENT OF MEDICAL ASSISTANCE SERVICES
Public Review Opportunity for § 1915 (c) Home and Community-Based Services Waivers Amendments
The Department of Medical Assistance Services (DMAS) welcomes public comment regarding the submission to the U.S. Centers for Medicare and Medicaid Services (CMS) of amended applications for the following § 1915 (c) Home and Community Based Services (HCBS) Medicaid Waivers: Commonwealth Coordinated Care Plus (CCC+), Community Living (CL), and Family and Individual Supports (FIS) Waivers.
The § 1915 (c) HCBS Waiver amendment applications can be found at https://dmas.virginia.gov/for-members/benefits-and-services/waivers/. The state is requesting amendments to revise the following. The waiver and appendix in which the item in question is being amended is shared after the item description:
1. Implementing a 56-hour soft cap limit on personal care and assistance with exceptions to request more hours to mirror the CCC+ Waiver (CL, FIS; Appendix C-1/C3)
2. Incorporating services facilitation into the statewide service broker model via the fiscal-employer agent contract and eliminating services facilitation as a standalone service (CCC+, CL, FIS; Transition Plan, Appendix E). Details of the transition are also available on the DMAS waivers page.
3. Modify program rules for consumer-directed services to allow an individual receiving services to serve as the employer of record (EOR) for the individual's own service delivery and designate another individual to perform all or a portion of the duties of the EOR on the individual's behalf when the individual receiving services is unable to perform such duties or direct the individual's own care (CCC+, CL, FIS; Appendix E).
4. Removing the eligibility group "Working Individuals with disabilities who buy into Medicaid (TWWIIA Basic Coverage Group as provided in §1902(a)(10)(A)(ii)(XV) of the Act)" under the waiver (CL, FIS; Appendix B-4).
5. Removing "Legally Responsible Person" as an allowable provider of the Employment and Community Transportation service (CL, FIS; Appendix C1/C3).
6. Correcting requirements for when a legally responsible individual is a paid caregiver and the individual uses the consumer-directed model. The prior language references a wrong form and an "enhanced enrollment agreement" that has been incorporated into the standard enrollment packet by the fiscal-employer agents (CL, FIS; Appendix C2).
7. Removing the requirement that DMAS staff perform higher level reviews when the individual is found to no longer meet the level of care to remain on the waiver (CCC+; Appendix B-6).
8. Updating service plan quality measures to remove the managed care organizations from performing the review (CCC+; Appendix D Quality Improvement).
9. The budget item to remove the live-in caregiver exemption from electronic visit verification requirements is not included in this waiver amendment. CMS has informed DMAS that no waiver amendment is required to make this change.
