Notice of Objection to Fast-Track Rulemaking Action
REGISTRAR'S NOTICE: Pursuant to § 2.2-4012.1 of the Code of Virginia, the Board of Medicine has filed a notice of objection to the fast-track rulemaking action published in 41:10 VA.R. 1246-1250 December 30, 2024. The board intends to proceed with the normal promulgation process set out in Article 2 (§ 2.2-4006 et seq.) of Chapter 40 of Title 2.2 of the Code of Virginia, with the initial publication of the fast-track regulation serving as the Notice of Intended Regulatory Action.
Title of Regulation: 18VAC85-40. Regulations Governing the Practice of Respiratory Therapists (amending 18VAC85-40-10, 18VAC85-40-55, 18VAC85-40-66, 18VAC85-40-70, 18VAC85-40-86; repealing 18VAC85-40-20, 18VAC85-40-30, 18VAC85-40-89).
Statutory Authority: §§ 54.1-2400 and 54.1-2912.1 of the Code of Virginia.
The Board of Medicine received a letter from Senator Todd Pillion objecting to the fast-track rulemaking process for the amendments proposed for 18VAC85-40 as published in 41:10 VA.R. 1246-1250 December 30, 2024. The objections describe concerns about amendments striking language in 18VAC85-40-70. Due to Senator Pillion's objection, the board has discontinued using the fast-track rulemaking process. The board will proceed with adoption of the amendments using the standard process under Article 2 (§ 2.2-4006 et seq.) of the Administrative Process Act, and the publication on December 30, 2024, will serve as the Notice of Intended Regulatory Action in accordance with § 2.2-4012.1 of the Code of Virginia.
