Notice of Intended Regulatory Action

Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the State Board of Health intends to consider amending 12VAC5-431, Sanitary Regulations for Hotels. The purpose of the proposed action is to amend the regulation to ensure effective governance of overnight lodging facilities throughout the Commonwealth. The amendments being considered will (i) remove outdated information; (ii) reflect best practices and the latest science from industry, academia, public health experts, and other stakeholders; (iii) clarify regulatory and enforcement standards; and (iv) include any additional amendments deemed necessary in response to public comment or input from industry and subject matter experts. The amendments are result of a periodic review concluded in 2022.

The agency does not intend to hold a public hearing on the proposed action after publication in the Virginia Register.

Public Comment Deadline: December 2, 2026.
