DMAS is specifically soliciting input from stakeholders, providers, and beneficiaries on the potential impact of the proposed changes discussed in this notice. Methods and Standards for Establishing Payment Rates; In-Patient Hospital Care (12VAC30-70)

In accordance with Chapters 225 and 226 of the 2026 Acts of Assembly, DMAS is revising the state plan to remove reference to the State and Local Hospitalization Program because the program has been repealed.

There is no expected increase or decrease in annual aggregate expenditures.

Methods and Standards for Establishing Payment Rate; Other Types of Care (12VAC30-80)

The state plan is being revised to include up to 10 doula visits, with up to four visits during pregnancy and up to six visits in the 12 months postpartum, with additional visits permitted if such visits are deemed medically necessary. This is in accordance with Chapter 682 of the 2026 Acts of Assembly, which codifies the Virginia Medicaid community doula benefit to include up to 10 visits (four prenatal and six postpartum) in the 12 months postpartum, support during labor and delivery, and up to two value-based linkage-to-care payments for postpartum and newborn care.

There are no expected increases or decreases in annual fee-for-service aggregate expenditures in federal fiscal year 2026 or federal fiscal year 2027.

Notice of Public Hearing for Schedule I Action Consistent with Federal Schedule I Changes

Pursuant to § 54.1-3443 E of the Code of Virginia, the Board of Pharmacy is giving notice of a public hearing to consider placement of chemical substances in Schedule I of the Drug Control Act (§ 54.1-3400 et seq. of the Code of Virginia). The public hearing will be conducted at 9:02 a.m. on June 16, 2026. Instructions will be included in the agenda for the board meeting, also on June 16, 2026. Public comment may also be submitted electronically or in writing prior to June 16, 2026, to the contact listed at the end of this notice.

Pursuant to article § 54.1-3443 E of the Code of Virginia, the following changes will be made to Schedule I to conform with federal scheduling action:

The board will add to Schedule I:

1. The following chemicals to Schedule I, including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers whenever the existence of such isomers, esters, ethers, and salts is possible within the specific chemical designation:

a. Ortho-chlorofentanyl (N-(2-chlorophenyl)-N-(1-phenethylpiperidin-4-yl)propionamide).

b. Meta-fluorofuranyl fentanyl (N-(3-fluorophenyl)-N-(1-phenethylpiperidin-4-yl)furan-2-carboxamide).

c. Ortho-methylcyclopropyl fentanyl (N-(2-methylphenyl)-N-(1-phenethylpiperidin-4-yl)cyclopropanecarboxamide).

d. Beta-methylacetyl fentanyl (N-phenyl-N-(1-(2-phenylpropyl)piperidin-4-yl)acetamide).

e. Tetrahydrothiofuranyl fentanyl (N-(1-phenethylpiperidin-4-yl)-N-phenyltetrahydrothiophene-2-carboxamide).

2. The following benzimidazole-opioid substances, including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers whenever the existence of such isomers, esters, ethers, and salts is possible, to Schedule I:

a. 2-(2-((2,3-dihydrobenzofuran-5-yl)methyl)-5-nitro-1H -benzimidazol-1-yl)-N,N-diethylethan-1-amine (commonly known as, ethyleneoxynitazene).

b. 2-(2-(benzodioxol-5-ylmethyl)-5-nitro-1H-benzimidazol-1-yl)-N,N-diethylethan-1-amine (commonly known as, methylenedioxynitazene or 3′,4′-methylenedioxynitazene).

c. 2-(2-(4-ethoxybenzyl)-5-methyl-1H-benzimidazol-1-yl)-N,N-diethylethan-1-amine (commonly known as, 5-methyl etodesnitazene).

d. N-ethyl-2-(5-nitro-2-(4-propoxybenzyl)-1H-benzimidazol-1-yl)ethan-1-amine (commonly known as, N-desethyl protonitazene).

e. 2-(2-(4-ethoxybenzyl)-5-nitro-1H-benzimidazol-1-yl)-N,N-dimethylethan-1-amine (commonly known as, N,N-dimethylamino etonitazene).

3. The following Cannabimimetic agents to Schedule I:

a.(4-ethylnaphthalen-1-yl)(1-(5-fluoropentyl)-1H-indol-3-yl)methanone (EAM-2201).

b. (4-methoxynaphthalen-1-yl)(2-methyl-1-pentyl-1H-indol-3-yl)methanone (JWH-098).

c. 3-((4-methylnaphthalen-1-yl)methyl)-1-pentyl-1H-indole (JWH-184).

d. (4-methylnaphthalen-1-yl)(1-(2-morpholinoethyl)-1H-indol-3-yl)methanone (JWH-193).

e. (2-methyl-1-pentyl-1H-indol-3-yl)(naphthalen-1-yl)methanone (JWH-007).

f. naphthalen-1-yl(1-(pent-4-en-1-yl)-1H-indol-3-yl)methanone (JWH-022).

g. (1-hexyl-5-phenyl-1H-pyrrol-3-yl)(naphthalen-1-yl)methanone (JWH-147).

4. The following hallucinogenic substance to Schedule I: 6,6,9-trimethyl-3-pentyl-6a,7,8,9,10,10a-hexahydro-6 H -benzo[ c]chromen-1-ol (also known as hexahydrocannabinol and HHC).
